In a unit test that has run hundreds of times, exactly once so far there was a runtime exception when accessing .tpe on a compiler-inserted type tag. Whatever it is, it's nondeterministic and low-probability (which is just what you want from your runtime).
Can't reproduce. But as a curiosity here's the stacktrace.

Perhaps you can test this hypothesis by configuring Specs to run your tests sequentially.
